A New York couple has been sued after buying and selling an over-the-counter drug called Viagra and having the same effects. The suits claim the couple sold the drug in New York without their knowledge, and that they should have known of the drug's dangerous effects.
The couple was arrested and charged with 18 counts of illegally selling an over-the-counter drug without a prescription, possession with intent to distribute, and attempting to sell it. They were charged with:
i) selling an over-the-counter product without a prescription;
ii) dispensing or dispensing on the market or on the order line of a pharmacy;
iii) possession with intent to supply; and
iv) and trafficking in a controlled substance.
The police raided the couple's home and arrested the couple on September 30, 2010.
The couple is seeking a new trial.
They had an initial trial on September 26, 2010. They were charged with 18 counts of illegally selling a prescription drug without a prescription. They were also arrested in the same amount that they were arrested for the first time. The police also entered into a conspiracy to conceal their crime and also a crime of distribution.
The charges were dismissed on September 30, 2010. The judge denied the new trial motion.
The couple was sentenced to a total of 360 days in jail and ordered to pay $100,000 in restitution to their family.
The court also ordered them to pay $1.2 million to the community.
The case is being prosecuted by Assistant United States Attorney Kenneth C. Schiller.
